1. Introduction

Welcome to Super Gifters! These Terms of Service ("Terms") govern your use of our website, mobile application, and services (collectively, the "Service") operated by Super Gifters ("we," "us," or "our").

By accessing or using our Service, you agree to be bound by these Terms. If you disagree with any part of these terms, then you may not access the Service.

2. Account Registration

To access certain features of our Service, you must register for an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain the security of your password and account
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized use of your account

3. Gift Services

Super Gifters provides a platform for purchasing, sending, and receiving digital and physical gifts. Our services include:

• Gift Coins purchases and redemption
• Digital gift delivery services
• Physical gift shipping and handling
• Gift Coins balance management and tracking

4. Payment Terms

All payments are processed securely through our authorized payment processors. By making a purchase, you agree to:

• Pay all charges incurred by you or on your behalf through the Service
• Provide valid payment method information
• Accept that all sales are final unless otherwise specified

5. User Conduct

You agree not to use the Service to:

• Violate any applicable laws or regulations
• Transmit harmful, offensive, or inappropriate content
• Attempt to gain unauthorized access to our systems
• Engage in fraudulent activities or money laundering

6. User-Submitted Designs & Intellectual Property

The Service may allow you to upload, submit, or create custom content such as images, logos, artwork, text, or other designs for use on products ("User Content"). You are solely responsible for your User Content.

By submitting User Content, you represent and warrant that: (a) you own the User Content or have all necessary rights, permissions, and licenses to use it; and (b) the User Content does not infringe or violate any third-party rights, including copyright, trademark, trade dress, patent, moral rights, rights of publicity, or privacy rights.

You may not submit User Content that you do not have the legal right to use (including copyrighted images, brand logos, celebrity likenesses, or protected characters) unless you have explicit authorization from the rights holder.

You retain ownership of your User Content. However, you grant Super Gifters a non-exclusive, worldwide, royalty-free, sublicensable license to host, store, reproduce, modify (only as needed for printing/production formatting), display, and use your User Content solely to (i) provide the Service, (ii) fulfill and deliver your order(s), (iii) show previews/confirmations within the Service, and (iv) provide customer support.

We reserve the right to reject, disable, remove, or limit any User Content (and/or suspend accounts) at our discretion, including where we believe content may be unlawful, infringing, or otherwise violate these Terms.

If you believe content on the Service infringes your copyright (or you are authorized to act on the rights holder—s behalf), you may submit a takedown notice to info@supergifters.co.ke with enough detail for us to review and act.

Please include all of the following:

1. Your full name (or company name), mailing address, telephone number, and email address.
2. Identification of the copyrighted work (or a representative list) you claim has been infringed.
3. Identification of the allegedly infringing material, including the relevant URL(s) and/or any order/product details sufficient for us to locate it.
4. A statement that you have a good-faith belief that the use of the material is not authorized by the rights holder, its agent, or the law.
5. A statement that the information in your notice is accurate, and (where applicable) made under penalty of perjury, that you are the rights holder or authorized to act on the rights holder—s behalf.
6. Your physical or electronic signature.

After receiving a complete notice, we may remove or disable access to the identified material and may notify the relevant user (including by sharing the notice contents, as required to process the request).

If you believe your content was removed by mistake or misidentification, you may submit a counter-notice to info@supergifters.co.ke including: (1) your contact information; (2) identification of the material removed and where it appeared; (3) a statement under penalty of perjury that you have a good-faith belief the removal was a mistake or misidentification; (4) a statement consenting to the jurisdiction of the appropriate courts in your location (or as otherwise required by applicable law); and (5) your physical or electronic signature.

This takedown/counter-notice process is provided for convenience and informational purposes only and is not legal advice.

You agree to defend, indemnify, and hold harmless Super Gifters and its affiliates, officers, employees, and partners from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of or related to your User Content or your violation of this section.

7. Privacy Policy

Your privacy is important to us. Our Privacy Policy explains how we collect, use, and protect your information when you use our Service. By using our Service, you agree to the collection and use of information in accordance with our Privacy Policy.

8. Limitation of Liability

In no event shall Super Gifters be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses.

9. Termination

We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever including without limitation if you breach the Terms.

10. Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 7 days notice prior to any new terms taking effect.
